The Estate Sale Checklist: How to Handle Property After the Loss of a Loved One
If you’re dealing with a deceased loved one’s estate, this checklist may help you to ensure that you complete all the necessary steps:
- Ensure probate has started, this procedure must be completed WITHIN 6 months in Spain from the date of death. If you’re unsure how to do this, speak to our experts for advice with no strings attached
- Ensure the property is secure – check it if you can, and take extra steps to avoid squatters such as installing safer locks, blocking windows, or adding security cameras
- Remove items of emotional value or items you wish to keep from the property
- Decide what will be sold with the property
- Furniture
- Car
- Soft furnishings: carpets, curtains, etc
- Dispose of anything you don’t wish to keep or sell with the property
- Arrange an estate sale for the items that will not be sold with the property and will not be kept by family
- Place the items in an auction
- Donate the items to charity – some charities offer a pick-up service
- Place the property on the market and wait for the offers to come in

- Legacy Estates will assign the property a value, and a sale price will be agreed upon
- You will then sign some paperwork to make it all official
- Sit tight while the offers roll in, this can take time. If you are in a rush to sell, negotiating the selling price with potential buyers may be recommended to speed up the process
- When the property has sold, we take care of the paperwork, ensuring that all the correct details are on the deeds, and that it is legally secure
- On completion of sale, you’re free to walk away with the proceeds!

- Now it’s time to be practical:
- The first thing you should do is get the electric and water bills transferred into your name, and for that you must:
- Get yourself on the padron by going to your local town hall with the deeds of your new property and your ID
- Register with the electricity and water company: most will accept a padron as proof of address along with your ID, and bank details for direct debit
- If you own a car that’s registered in Spain, you must change your address on the DGT website – this must be done within 10 days of moving
